Orange County Motorcycle Accident Attorneys

A motorcycle accident can cause serious injuries before you have any chance to protect yourself.

When another driver’s negligence causes the crash, the resulting medical treatment, lost income, property damage, and long-term limitations can quickly become difficult to manage.

An Orange County motorcycle accident lawyer can investigate what happened, deal with the insurance companies, and pursue compensation for the losses caused by the collision.

Motorcycle accident claims often involve more than determining which driver caused the collision. The severity of the injuries, available insurance coverage, comparative fault, road conditions, and evidence from the scene can all affect the value and outcome of a claim.

Easton & Easton, LLP has extensive experience handling vehicle accident cases in Orange County, including serious motorcycle crashes. We understand the challenges that can arise when an insurance company evaluates a claim involving substantial injuries. An insurer may question liability, dispute the extent of your injuries, or offer less than the claim is worth.

Reach out to Easton & Easton today to schedule a consultation. We can help investigate the accident, identify the responsible parties, and pursue available insurance coverage. When insurance does not fully compensate you for your losses, we can also pursue a personal injury claim for the remaining damages.

3 Things You Should Know After a Motorcycle Accident in Orange County, CA

  • Get the names, contact information, and insurance information of the people involved, along with contact information for witnesses.
  • Avoid giving a recorded or written statement to an insurance company before speaking with an attorney about your claim.
  • Contact Easton & Easton, LLP as soon as possible so we can help you understand what to do next.

A motorcycle accident lawyer can also investigate how the collision happened and determine which parties may be legally responsible. Depending on the circumstances, that could include another driver, a commercial vehicle operator, a company, or a government entity responsible for maintaining the roadway.

$3,060,000 Lane Splitting Motorcycle Accident in Carpool Lane

Easton & Easton, LLP obtained a $3,060,000 recovery for a client injured in a motorcycle accident on the 405 freeway. The collision occurred when a shuttle bus crossed double yellow lines and entered the carpool lane while our client was lane splitting near the edge of the lane.

The bus company initially disputed liability and argued that our client’s lane splitting contributed to the collision. We investigated the circumstances and established that the bus driver’s illegal lane change caused the crash. The bus company ultimately accepted full responsibility.

California law expressly permits lane splitting under California Vehicle Code section 21658.1. Lane splitting, by itself, does not establish that a motorcyclist caused an accident.

Our client suffered a fractured pelvis, torn ACL, internal degloving wounds, and other serious injuries. He underwent three surgeries and more than a year of physical therapy and incurred approximately $300,000 in medical expenses.

After we demonstrated the extent of the injuries and their effect on his life, the shuttle bus company sought an early mediation. The case settled for $3,060,000 without our client having to undergo a deposition or trial.

Every case is unique. Results obtained in past legal matters depend on the specific facts and legal circumstances of each case and do not guarantee or predict a similar outcome in future cases.

Why Motorcycle Accidents Can Cause Serious Injuries

Motorcycles provide substantially less physical protection than passenger vehicles. A car surrounds its occupants with a structural frame and may include seat belts, airbags, and crumple zones designed to reduce the force of a collision. A motorcyclist remains exposed to the impact of another vehicle and to the roadway itself.

A rider can suffer catastrophic injuries even when wearing appropriate protective equipment. Common motorcycle accident injuries include:

  • Broken bones: A collision with a larger vehicle or impact with the roadway can cause fractures ranging from relatively minor breaks to severe crushing injuries.
  • Traumatic head injuries: The National Highway Traffic Safety Administration reports that motorcycle helmets are about 37% effective at preventing rider deaths. A properly approved helmet can reduce the risk of fatal head injuries, but it cannot eliminate the possibility of serious brain trauma.
  • Spinal cord injuries: Damage to the spinal cord can result in permanent impairment and may require extensive medical treatment and rehabilitation.
  • Road rash: A rider thrown from a motorcycle may slide across asphalt or concrete. The resulting friction can cause severe abrasions and damage to deeper layers of skin and tissue.

Common Causes of Motorcycle Accidents in Orange County, CA

Visibility is a major factor in many motorcycle collisions. Motorcycles are smaller than passenger vehicles, which can make them more difficult for other drivers to notice, particularly when changing lanes, turning, entering intersections, or traveling through congested traffic.

Motorcyclists have the same legal rights and responsibilities as other drivers on California roads. Other motorists must account for motorcycles when changing lanes, turning, merging, and proceeding through intersections.

Left-turn collisions are particularly dangerous. A driver turning left may fail to see an approaching motorcycle or misjudge its distance and speed. The same problem can occur when a motorcyclist passes or overtakes a vehicle in an adjacent lane.

According to NHTSA data, 46% of fatal two-vehicle motorcycle crashes involve a vehicle turning left in front of a motorcycle traveling straight, overtaking, or passing. A motorcyclist may have little time to avoid a vehicle that suddenly crosses the rider’s path.

Other causes can include:

  • Distracted driving
  • Driving under the influence
  • Unsafe lane changes
  • Failure to yield
  • Speeding
  • Following too closely
  • Aggressive or reckless driving
  • Dangerous roadway conditions

The cause of the collision matters because establishing liability requires evidence showing what the other driver or responsible party did wrong and how that conduct caused the accident. Understanding what kind of cases personal injury lawyers handle in California provides insight into how various roadway negligence scenarios are built.

Handling Serious Injuries After an Orange County Motorcycle Crash

A motorcycle crash can leave a rider facing extensive medical treatment, lost income, and limitations that continue long after the collision.

Serious injuries may include spinal cord trauma, traumatic brain injuries, severe burns, fractures, and other conditions requiring ongoing care.

Roadway defects can create another source of liability. A pothole, dangerous surface condition, inadequate roadway design, or other defect that might pose little danger to a passenger vehicle could cause a motorcyclist to lose control.

When a dangerous condition contributed to the accident, the government entity responsible for the roadway may potentially be liable.

Claims against a government entity are also subject to a much shorter deadline than an ordinary injury claim. Under California Government Code section 911.2, a claim against a public entity for personal injury generally must be presented within six months of the accident, not the standard two-year window that applies to most other personal injury claims.

Missing this deadline can permanently bar the claim, even if the two-year period has not yet passed. These claims can involve additional legal requirements and often require detailed investigation and expert analysis.

Motorcycle injury claims can also face assumptions about rider behavior. A driver’s or investigator’s perception that a motorcyclist was speeding, lane splitting, or riding aggressively does not establish liability by itself. The evidence must show what actually caused the collision.

Our attorneys can investigate the physical evidence, witness accounts, accident reports, vehicle damage, roadway conditions, and other available evidence to determine whether the facts support your claim.

Potential Damages in an Orange County Motorcycle Accident Lawsuit

The damages available in a motorcycle accident case depend on the injuries, financial losses, liability issues, and other facts involved. Potential compensation can include:

  • Medical expenses: This may include emergency transportation, hospital treatment, surgery, medication, rehabilitation, physical therapy, and future medical care related to the accident.
  • Property damage: A claim may include the cost of repairing or replacing the motorcycle and other property damaged in the collision.
  • Lost income: If your injuries prevent you from working, you may be able to recover income lost during your recovery. A permanent disability may also affect your future earning capacity.
  • Pain and suffering: Serious physical injuries can cause ongoing pain, emotional distress, and other non-economic harm. California law permits recovery for these losses in appropriate personal injury cases.

You must support claimed damages with evidence. Medical records, employment records, bills, expert opinions, and other documentation can help establish the extent of your losses.

In some cases, punitive damages may also be available. These damages are different from compensation for the victim’s losses and may apply when the defendant’s conduct meets the legal standard for punitive damages. Asking questions to ask a California personal injury lawyer before hiring helps ensure your legal counsel is fully equipped to substantiate complex non-economic and punitive damages.

Filing an Auto Insurance Claim After a Motorcycle Accident

California requires drivers to maintain minimum levels of automobile liability insurance. Under the current minimum coverage requirements, a California policy must provide at least:

  • $30,000 for bodily injury to one person;
  • $60,000 for bodily injury to multiple people in one accident; and
  • $15,000 for property damage.

These minimums increased from $15,000/$30,000/$5,000 on January 1, 2025, under Senate Bill 1107.

Minimum insurance coverage may be enough for some minor accidents, but serious motorcycle injuries can generate damages far beyond the available policy limits. California also has a significant number of uninsured drivers. According to the California Department of Insurance, roughly one in six California drivers is uninsured.

Uninsured and underinsured motorist coverage can become important when the driver who caused the accident does not have enough insurance to cover your losses. If you have applicable coverage, you may be able to pursue compensation through your own insurance policy. Learning how personal injury settlements are paid out in California offers guidance on structure and distribution options when coordinating policy recoveries.

How to Build a Motorcycle Accident Injury Claim in Orange County

A successful motorcycle accident claim starts with identifying who caused the collision and gathering evidence that supports liability and damages.

Potentially responsible parties can include another driver, a commercial vehicle operator or company, a property owner, or a government entity responsible for roadway maintenance, depending on the circumstances.

Your medical records and other documentation should establish the injuries caused or aggravated by the accident. If a preexisting condition was worsened by the collision, California law may allow recovery for the additional harm caused by the accident. The evidence must distinguish that new loss from medical expenses or conditions that existed beforehand.

To establish negligence, your attorney generally must prove that the defendant owed you a duty of care, breached that duty, and caused your injuries and resulting damages. The evidence needed to establish those elements will depend on how the accident occurred.

Comparative Fault in California Motorcycle Accident Cases

Fault is not always limited to one person after a motorcycle accident. An insurance company or defendant may argue that the motorcyclist contributed to the collision.

California follows a pure comparative fault system, which means a person’s recovery can be reduced by the percentage of fault assigned to that person.

Under pure comparative fault, an injured plaintiff is not automatically barred from recovering because the plaintiff was partially responsible. Instead, the plaintiff’s compensation is reduced according to the percentage of fault assigned to the plaintiff.

For example, if you were found 20% responsible for an accident and your total damages were $500,000, your recovery could be reduced by 20%, subject to the facts and applicable law.

Because even a relatively small percentage of fault can substantially affect a serious injury claim, evidence concerning how the collision occurred can be critical.

FAQs About Orange County, CA Motorcycle Accident Laws

What Should I Do After a Motorcycle Accident in Orange County, CA?

First, move to a safe location if you can do so without worsening your injuries. Call 911 if anyone needs medical attention and report the collision to law enforcement.

If you are able, obtain the other driver’s information and identify witnesses. Take photographs of the accident scene, vehicles, roadway conditions, and visible injuries when it is safe to do so.

Seek medical attention even if your injuries initially appear minor. Some injuries become more apparent after the initial shock of a collision wears off.

Before giving a recorded statement or accepting an insurance settlement, consider speaking with a motorcycle accident attorney about your rights.

What Is The Average Payout For A Motorcycle Accident in Orange County?

The value of a claim depends on factors such as the nature and severity of the injuries, medical expenses, lost income, property damage, available insurance, liability, comparative fault, and the long-term effects of the accident.

A minor injury claim and a claim involving a permanent spinal injury can have dramatically different values. An attorney can review the specific evidence in your case and explain the damages that may be available.

When Should I Call A Motorcycle Accident Attorney?

You should consider contacting an attorney as soon as possible after a serious motorcycle accident, particularly when liability is disputed, injuries are substantial, or insurance coverage may be inadequate.

Early legal involvement can allow an attorney to investigate while evidence is still available and witnesses’ recollections remain fresh.

Should I Get a Lawyer After a Motorcycle Accident?

If your accident caused significant injuries or property damage, an attorney can help you evaluate liability, communicate with insurance companies, document your losses, and pursue available compensation.

You can handle a claim yourself, but serious motorcycle accident cases can involve complicated liability and insurance issues. Having legal counsel can also help you avoid making statements or accepting settlements before you understand the full value of your claim.

How Long Will It Take to Resolve My Motorcycle Accident Case?

Some cases resolve through an insurance settlement relatively quickly. Others take longer because the injured person needs additional medical treatment, liability is disputed, damages are substantial, or litigation becomes necessary.

It is generally important not to settle a serious injury claim before you understand the full extent of your injuries and future losses.

What If My Motorcycle Accident Was Caused By A Hit-And-Run Driver?

Report the hit-and-run to law enforcement and seek medical treatment for any injuries. If you can safely do so, document the accident scene and gather information about the vehicle and driver, including the direction of travel, vehicle description, and license plate information.

Witnesses may also have information that helps identify the driver.

Insurance coverage can become especially important in a hit-and-run accident. Depending on your policy, uninsured motorist coverage may provide a potential source of compensation. An attorney can review your policy and the facts of the accident to determine what options may be available.

What If My Loved One Was Killed In A Motorcycle Accident?

A fatal motorcycle accident can create both financial and legal consequences for surviving family members. Depending on the circumstances, eligible family members may be able to pursue a wrongful death claim for damages permitted under California law. When fatal collisions occur, consulting a dedicated Orange County wrongful death lawyer helps families understand their rights.

Evidence from the accident scene, police investigation, medical records, insurance policies, and other sources can be important to determining liability and damages.

Will the Defendant Go to Jail for Causing My Motorcycle Accident?

A personal injury claim and a criminal prosecution are separate matters. A driver who causes an accident through negligence may face civil liability for the resulting damages. If the driver also violated a criminal law, prosecutors may separately pursue criminal charges.

Whether criminal consequences apply depends on the driver’s conduct and the circumstances of the collision.

Is Lane Splitting Legal in California, and Can It Affect My Claim?

Yes. California law permits lane splitting under California Vehicle Code section 21658.1.

The fact that a motorcyclist was lane splitting does not automatically establish fault. However, an insurance company or opposing party may argue that the rider’s conduct contributed to the collision. The specific facts, roadway conditions, speeds, positions of the vehicles, and other evidence must be evaluated to determine how liability should be assigned.
